Summary
Thesis by a family prosecutor who investigates which criteria prosecutors use to apply remission at the preliminary stage to adolescents who have committed offences, and whether they are compatible with the principles of the restorative youth justice model. It concludes that there are incompatibilities: prosecutorial remission does not provide for direct reparation of the harm to the victim, for acknowledgement of the offence as a prior step, or for a procedure that informs the victim from the outset. It proposes regulatory and, in some cases, practical solutions. It is useful for prosecution teams and for those evaluating restorative youth justice in Peru.
