Summary

An essay derived from a paper at the 2nd Argentine Congress on Restorative Justice and Practices (March 2026). It presents restorative justice as a cultural response to punitive hardening in an era marked by automation and the logic of efficiency. Drawing on the author's work in prisons and at Víctimas por la Paz, it argues that conflict belongs to people and not to the State, and develops three ideas: the victim's sovereignty over their own pain, kindness as a condition for the validity of justice, and communities that repair themselves from within, with the example of the Fondo de Ayuda a Víctimas promoted from Liberté in Unit 15 of Batán.
