Summary

The Dutch-language version of a research note by the Belgian institute of criminology on herstelbemiddeling before judgment, the mediation that the Act of 22 June 2005 makes available for any offense and at any stage of criminal proceedings. Although prosecutors and judges are required to inform the parties of this option, they rarely do so, and mediation is little used. The author brings together the arguments of reluctant magistrates: limited knowledge of the mechanism, difficulty conceiving of it before trial, and a sense that it adds nothing. Useful for mediation services and judicial teams seeking to improve case referral.
