Summary
An opinion column on the decision of Judge Marta Pascual, of Juvenile Criminal Responsibility Court No. 2 of Lomas de Zamora, who in a collective habeas corpus preventively suspended the application of the new Juvenile Criminal Regime (Law 27.801) in the province of Buenos Aires. Based on the conditions at the Centro de Recepción y Ubicación of Lomas de Zamora, it argues that extending criminal responsibility to 14- and 15-year-olds without infrastructure or budget produces cruel treatment, breaks community ties, and empties the socio-educational purpose of the jurisdiction. It is useful for following the application of the juvenile criminal reform.
