Summary

Describes how restorative justice is applied to offences against life in Guatemala and compares it with other Latin American legislation, including that of Argentina, Mexico and Costa Rica. Through documentary analysis of rules, case law and literature, it argues that restorative justice is a viable alternative because it focuses on repairing harm and reintegrating the person responsible, although its practical application faces limits in resources and training. It suggests that traditional Guatemalan indigenous practices could be adapted to the criminal justice system and that the regulatory framework needs strengthening. It is useful for those working in criminal law and restorative justice in Guatemala.
