Summary

A research note published by Belgium's Institut National de Criminalistique et de Criminologie (National Institute of Criminalistics and Criminology) on restorative mediation before judgment, provided for by the Act of 22 June 2005 for all types of offenses and at every stage of criminal proceedings. The law requires prosecutors and judges to inform the parties of this possibility, but the obligation is rarely fulfilled and mediation is little used. The text sets out the reasons given by reluctant magistrates: lack of knowledge of the mechanism, difficulty conceiving of it before trial, and the view that it would be pointless. Useful for those working on the link between mediation services and the courts.
