Summary

The Dutch-language version of the Belgian federal law extending mediation to every stage of criminal proceedings and to any type of offense; in Flanders it is known as herstelbemiddeling. It inserts article 3ter into the Preliminary Title of the Code of Criminal Procedure, under which persons with a direct interest in the proceedings may request voluntary mediation with a neutral third party, and reinstates articles 553 to 555 on requests, mediation services, and the obligation of prosecutors and judges to inform the parties. It also provides that the judgment may refer to elements of the mediation. Useful for studying the Belgian model in its official text.
