Summary

A Belgian federal law that extends mediation to the entire criminal process, for any type of offense. It adds article 3ter to the Preliminary Title of the Code of Criminal Procedure, enabling persons with a direct interest in judicial proceedings to request mediation, understood as a voluntary and confidential process with a neutral third party. It reinstates articles 553 to 555 of the Code of Criminal Investigation on requests for mediation, the services that conduct it, and the duty of prosecutors and judges to inform the parties, and allows the judgment to refer to what took place in mediation. It is the basis of what is known in Belgium as restorative mediation.
