Summary
Basic principles annexed to resolution 2002/12 of the United Nations Economic and Social Council, approved on July 24, 2002. The resolution encourages Member States to take them as a reference in developing and managing restorative justice programs in criminal matters. They are not binding. According to the Spanish text, restorative processes are used when there is sufficient evidence against the offender and with the free and voluntary consent of the victim and the offender.
